JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 01-08-2018 This application has been filed on behalf of Tara Mehta Sant Kabir Sanskri High School, Sahdullapur (Malighat), Muzaffarpur, seeking a direction to the respondent to treat the said School as located under the urban area of Muzaffarpur Town and under the territorial jurisdiction of the Muzaffarpur Municipal Coroporation, Muzaffarpur, since according to the petitioner, the School is situated at the boundary of urban area of
Patna High Court CWJC No.2606 of 2018(2) dt.01-08-2018 2/2 Muzaffarpur Town, Ward no. 45, Muzaffarpur. This is a matter which can be decided by the executive authority only and not in a proceeding under Article 226 of the Constitution of India This Court does not have any judicially determinable parameter to consider the grievance of the petitioner. It will, however, be open to the petitioner to pursue his grievance before the competent authority which the petitioner's claims to have done by filing a representation before the authority by way of Annexure-1 series. The Court expects that the respondents will examine the petitioner's claim and take a decision in accordance with law, preferably within a period of six months from the date of receipt/production of a copy of this order. This disposes of the application.
