JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-02-2020 Heard learned counsel for the petitioner and the State. The petitioner is apprehending arrest in connection with Shahkund (Sajour) P.S. Case No. 307 of 2019 for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that on the basis of secret information raid was conducted in the absence of the petitioner and his family members. Total 8.625 litre liquor was seized.

Considering the fact that the petitioner has no criminal antecedent and the raid was conducted in the absence of the petitioner and his family members, the Court is inclined to grant bail to the petitioner named above, in the event of arrest or

No.7248 of 2020(2) dt.29-02-2020 2/2 surrender within four weeks from today, on furnishing bail bonds of Rs.25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum-Special Judge (Excise), Bhagalpur in connection with Shahkund (Sajour) P.S. Case No. 307 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
