Case No. 49 of 2014, as such they have been heard together and are being disposed of by this common order.
Heard learned counsel for the petitioners and learned A.P.P. for the State.
The accused-petitioners seek bail in a case registered for the offence punishable under Section 414 of IPC. Allegation against the petitioners is that they were trying to sell the stolen truck and were apprehended on the spot. It is submitted that the petitioners were crossing from the place where the truck was standing. They have no criminal antecedents and after their arrest they have been remanded in Phulparas P. S. Case No. 201 of 2014 for the offence punishable under Section 379 of IPC which has been lodged for the theft of the aforesaid truck. It has also been submitted that in similar facts
Patna High Court Cr.Misc. No.40304 of 2014 (3) dt.10-02-2015 3/3 and circumstances, co-accused Sitaram Rai has been granted bail vide Cr. Misc. No. 2959 of 2015.
Considering the facts and circumstances, the above named petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) each with two sureties of the like amount each to the satisfaction of Ms. Noor Sultana, learned Judicial Magistrate, 1st Class, Vaishali at Hajipur/court concerned in Tisiauta P. S. Case No. 49 of 2014 with following conditions:-
1. The petitioners will not indulge themselves in similar or any other offence.
2. One of the bailors must be the close relative of the petitioners.
3. The petitioners will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, their bail bonds would be liable to be cancelled by the learned Court concerned.
