The petitioner seeks bail in connection with Parbatta P.S. Case No. 53 of 2019 for the offence under Sections 37(C) of the Bihar Prohibition and Excise Amendment Act, 2018 and Section 25(1-b)a and 26 of the Arms Act.

Learned counsel appearing for the petitioner submits that earlier the prayer for bail of this petitioner had been rejected by this Court vide order dated 18.12.2019 passed in Cr. Misc. No. 76707 of 2019. In fact, nothing has been recovered from the conscious possession of the petitioner. It is submitted that the petitioner has remained in

Patna High Court CR. MISC. No.17626 of 2021(2) dt.28-07-2021 2/2 custody for approx one and half year and on ground of period of custody, the petitioner has renewed his prayer for bail.

Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Khagaria in connection with Parbatta P.S. Case No. 53 of 2019.
