JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-05-2019 This is an application for grant of anticipatory bail in connection with Mirganj P.S. Case No. 235 of 2018, disclosing offences under Sections 147, 148, 149, 307, 380, 504, 427, 435 of the Indian Penal Code and Section 27 of the Arms Act. Allegation as per F.I.R. is that 71 persons including the petitioners came and assaulted the informant and take away away the ornaments.
Submission of learned counsel for the petitioners is that a large number of persons have been made accused in this case and nothing specific has been attributed against the petitioners. Further submission is that one of the co-accused has been granted privilege of anticipatory bail by this Court vide
Patna High Court CR. MISC. No.18473 of 2019(3) dt.06-05-2019 2/2 order dated 08.04.2019 passed in Cr. Misc. No. 22360 of 2019. Heard learned A.P.P. also.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Mirganj P.S. Case No. 235 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
