====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 07-01-2022 Heard the learned counsel for the parties.
The petitioner seeks bail in anticipation of his arrest in connection with Mansi P.S. Case No. 263/2020 instituted for the offences under Sections 341, 323, 504, 506, 498A and 34 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that he is separate in mess and business from the husband of opposite party no. 2. Merely because of his relationship
Patna High Court CR. MISC. No.17556 of 2021(2) dt.07-01-2022 2/3 with his brother, he has been made accused in this case. Mr. Chaudhary, learned counsel for the opposite party no. 2, however, contends that the petitioner stays in the same household where the O.P. No. 2 resided with her husband. The victim / O.P. No. 2 has been neglected by her husband and the petitioner and other family members had given tacit support to her husband.
The learned counsel for the petitioner, however, has informed this Court that the husband of O.P. No. 2 has already been granted anticipatory bail by a Bench of this Court.
Regard being had to the afore-stated facts, the petitioner is also directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Mansi P.S. Case No. 263/2020, subject to the
Patna High Court CR. MISC. No.17556 of 2021(2) dt.07-01-2022 3/3 condition laid down under Section 438 (2) of the Code of Criminal Procedure.
