JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-04-2022 Heard Ms. Anju Mishra, learned advocate for the petitioner and Mr. Krishn Deo Pandit for the victim. The State is represented by learned Additional Public Prosecutor. The petitioner seeks bail in anticipation of his arrest in connection with Katihar Town P.S. Case No. 304 of 2019 dated 11.05.2019 instituted for the offences under Sections 366 of the Indian Penal Code.

Though the allegation in the F.I.R. is of the petitioner having kidnapped the victim but, ultimately, the petitioner and the victim have married and have settled in life and they have also been blessed with a child.

The learned counsel for the victim has stated before this Court that the victim does not wish to prosecute the petitioner any further. He further submits that the victim wants
