The petitioner seeks bail in Kanti P.S. Case No.875 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

Allegation against the petitioner is about recovery of 17liters of foreign liquor from a room of a hotel owner of the petitioner situated back side of the hotel near a boundary wall of the hotel.

Submission of learned counsel for the petitioner is that the petitioner has been falsely implicated in this case and he in custody since 02.12.2019. Further submission is that nothing has been recovered from the conscious possession of the petitioner, rather it was recovered from a room, which does

Considering nature of allegation, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/-(twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Kanti P.S. Case No.875 of 2019.
