JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-09-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is in custody in a case registered under Sections 498(A), 306, 34 of the Indian Penal Code. Section 302 of the Indian Penal Code was added later on.

The petitioner happens to be the husband of the deceased and according to FIR itself, the deceased set fire on her cloth due to petty dispute on 08.03.2015 but the present case was lodged on 12.03.2015. It would appear from perusal of the impugned order that in course of treatment, the deceased died and after that Section 302 of the Indian Penal Code was added. The police submitted charge sheet for the offence punishable under Sections 498A and 306 of the Indian Penal Code.

No.42179 of 2015 (2) dt.15-09-2015 2/2 Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Bhojpur at Ara in Piro P.S.Case No. 79 of 2015.
