JUSTICE AMARESH KUMAR LAL ORAL ORDER 04-08-2015 Both these applications arise out of Economic Offences Police Station Case No.21 of 2014 (Special Case No.31 of 2014) registered for the offence punishable under Sections 20B (I)/23/29 of the Narcotic Drugs and Psychotropic Substances Act, as such, they have been heard together and are being disposed of by this common order.

Patna High Court Cr.Misc. No.39783 of 2014 (8) dt.04-08-2015 2/2 Heard the learned counsel for both the parties. The allegation against the petitioners and co-accused Pramod Paswan is that they were travelling by a truck, which was searched by the police party and from their possession 537 Kg. of Ganja were recovered, which were kept in the chamber behind the cabin of the truck.

It is submitted that the petitioners had no knowledge about the incriminating articles (Ganja) kept in the chamber behind the cabin of the truck. They have no criminal antecedents. The petitioner Balraj Singh was the driver of the truck, whereas, the petitioner Indrajeet Singh was travelling on the truck. The learned counsel for the Economic Offences Unit submits that a huge quantity of Ganja has been recovered from the truck on which the petitioners were travelling. They were in possession of the incriminating articles (Ganja).

After investigation, the case has been found true against the petitioners. Considering the facts and circumstances of the case, in my opinion, the petitioners do not deserve bail. Their prayer for bail is rejected.
