JUSTICE SUDHIR SINGH ORAL ORDER 05-11-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 20, 21 and 22 of the Narcotic Drug and Psychotropic Substance Act and 25 ( 1-BA), 26/ 35 (1-AA)/35 of the Arms Act. Allegation against the petitioner is that from his house 525.65 Kg. Ganja, 2.270 Kg. Charas, 9 pistols and two country made pistols are said to have been recovered. It has been submitted on behalf of the petitioner that he is in custody since 21.5.2015. Chargesheet has been submitted in the present case. There is no allegation of tampering of evidence against the petitioner.

As per prosecution case, from the house of the petitioner 525.65 Kg. Ganja is said to have recovered along with 2.270 Kg. Charas, 9 pistols and 2 country made pistols and other articles. At the alleged time of seizure petitioner was not present there and is said to have been implicated in the present case.

On behalf of the State, it is submitted that huge quantity

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner, same is rejected. Any how, the trial court, i.e., learned Sessions Judge, Madhubani, is directed to take all necessary steps to expedite the trial in connection with Kaluahi P. S. Case no. 35 of 2015 and conclude the same preferably within a period of one year from the date of receipt/production of a copy of this order. (Sudhir Singh, J) sudip/- U T
