JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-02-2020 The petitioner seeks regular bail in connection with Choutham P.S. Case No. 274 of 2019, registered for offences punishable under Section 414 of the Indian Penal Code. Prosecution case is that police on information that three persons have assembled at Bajrangbali Asthan and making a deal to sell the stolen motorcycles, on which, the police went there and on seeing the police, four persons on three motorcycles started fleeing away, however, on chase three of them were caught and they did not show the valid documents of the motorcycle and further from the identification of one of the accused, one stolen motorcycle was recovered from the Basa of the petitioner.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and the Basa, from

Patna High Court CR. MISC. No.5507 of 2020(2) dt.04-02-2020 2/2 where, recovery was made is situated far away from the house of the petitioner. Further submission is that he has no criminal antecedent he has been in judicial custody since 13.11.2019. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -III, Khagaria, in connection with Choutham P.S. Case No. 274 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
