The petitioner seeks bail in a case registered for the offence under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case due to land dispute between the parties. It is further submitted that petitioner was exonerated by the police after completion of investigation, but the learned court below has taken cognizance differing with the final form submitted by the police. Petitioner is lady and is in custody since 29.10.2021.

However, learned counsel for the informant opposed the prayer for bail and submitted that there is specific allegation

Considering aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Araria / concerned court in connection with Bhargama P.S. Case No. 8 of 2021.
