JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 13-02-2026 The petitioner was granted regular bail vide order dated 12.01.2026 passed in Cr. Misc. No. 65126 of 2025. While granting bail, it was observed in paragraph 7 of the order that before accepting the bail bond, the criminal antecedent of the petitioner shall be verified and if it is found that he is involved in any other case except the cases mentioned in paragraph-3 of the bail application, his bail bond shall not be accepted.

2. Learned counsel for the petitioner has submitted that the petitioner had mentioned one case i.e. Naubatpur P.S. Case No. 797 of 2024 under Sections 304(2), 112(2) of the BNS in paragraph no. 3 of the bail application and due to lack of knowledge, Piplawan P.S. Case No. 117 of 2024 under Section

Patna High Court CR. MISC. No.9687 of 2026(2) dt.13-02-2026 2/2 309(4) of the BNS, had been left to be mentioned in paragraph-3 of the bail application.

3. Considering the facts and circumstances, the present modification application is allowed to the extent in paragraph-7 of the order dated 12.01.2026 that, before accepting the bail bond, the criminal antecedent of the petitioner shall be verified and if it is found that he in involved in any case other than Naubatpur P.S. Case No. 797 of 2024 and Piplawan P.S. Case No. 117 of 2024, his bail bond shall not be accepted.

4. Accordingly, the period for surrender of the petitioner is further extended for four weeks from today.

5. All the terms and conditions shall remain same as in order dated 12.01.2026 passed in Cr. Misc. No. 65126 of 2025.
