2. The petitioner is apprehending arrest in connection with Harnaut P.S. Case No. 230 of 2019 registered on 08.06.2019 for the offenses punishable under Sections 447, 307, 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution, an F.I.R. has been lodged against six named accused persons, including the present petitioner, against whom there is a direct allegation of firing at his own brother, resulting in injury.

4. It is submitted by learned counsel for the petitioner that the the petitioner is innocent and has committed no offence. In fact, the accusation has been levelled in the background of land dispute.

5. Learned APP for the State vehemently opposes the prayer for bail and submits that this is a case of the year 2021. The anticipatory bail of the petitioner was rejected by the District and Sessions Judge, Bihar Sharif, Nalanda, in 2021, and the petitioner has filed the present application against the rejection order after a delay of four years.

6. In this background, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with Harnaut P.S. Case No. 230/2019, pending before the learned C.J.M., Nalanda, Bihar Sharif, is hereby rejected.

7. However, it is directed that the petitioner shall surrender before the Trial Court within a period of four weeks from today. In case the petitioner surrenders within this period, the Trial Court is directed to pass an order on his surrender-cumbail application on the same day, without being prejudiced by the fact that the petitioner's anticipatory bail has been rejected by this Court.
