The petitioners have prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 325, 307, 504, 506/34 of the Indian Penal Code. As per prosecution case, when the informant along with his family members was working in their agricultural field, in the meantime, the accused persons including the petitioners came with a tractor and started ploughing the land which is under dispute. On protest, the accused persons assaulted the informant as well as his family members due to which they sustained injuries.
Learned counsel for the petitioners submit that the
Patna High Court CR. MISC. No.8682 of 2023(2) dt.17-04-2023 2/2 petitioners are innocent and have committed no offence. The informant and the petitioners are agnates and an admitted land dispute was going on between them, due to which the petitioners have falsely been implicated in this case. From perusal of FIR, there is no specific overt act attributed to the petitioners rather general and omnibus allegation leveled against them. It is further submitted that the petitioner is languishing in judicial custody since 26.11.2022.
Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioners, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Muffasil P.S. Case No. 269 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Nawada.
