====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-03-2025 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 406, 409, 420 of the Indian Penal Code.

3. Prosecution case, in brief, is that this petitioner who was the then Panchayat Secretary of Ramgrahwa Block was also given charge of Gram Panchayat Dhanhar Dahuli, Sheosagar and Singhasini but despite repeated requests, petitioner did not hand over the charge of Sheosagar and Singhasini and on account of which, development works in these panchayats were hampered.

4. Learned counsel for the petitioner submits that at the relevant time, petitioner was posted as Panchayat Secretary in Ramgrahwa Block and was in-charge of Gram Panchayat Dhanhar Dahuli only and charge of Sheosagar and Singhasini

Patna High Court CR. MISC. No.6836 of 2025(2) dt.17-03-2025 2/2 was never given to the petitioner. So far as Gram Panchayat Dhanhar Dahuli is concerned, he has already given charge of the same. Petitioner has been made accused in this case due to some misunderstanding. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering backdrop of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Ramgarhwa P. S. Case No. 280 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
