2. The present writ petition has been filed for a direction to the Collector, Vaishali (respondent no. 1) to dispose of the appeal bearing no. R-309/2016-17 (Bhola Singh vs. Sub-Divisional Officer, Mahua, P.D.S. Appeal) against the letter no. 66 dated 20.01.2015 passed by the Sub-Divisional Officer, Mahua, District- Vaishali (Annexure-4) whereby the license of the petitioner has been cancelled.

3. At the very outset, this Court takes note that the petitioner has already filed an appeal being Appeal No. R-309/2016-17 before the Collector, Vaishali against the impugned order which is still pending.

4. Learned counsel for the respondents appears and has been heard.

5. Having regard to the nature of the prayer of the petitioner, the writ petition is disposed of with a direction to the Collector, Vaishali (respondent no. 1) to consider and dispose of the Appeal bearing No. R-309/2016-17, if still pending, on its own merit and in accordance with law after grant of opportunity of hearing to the petitioner, expeditiously and preferably within a period of two months from the date of receipt/production of a copy of this judgment (Vikash Jain, J) Md.
