2. The petitioner has preferred this application for grant of regular bail in connection with Katihar Muffasil P.S. Case No. 86 of 2023 dated 02.05.2023 registered for the offence punishable u/s 406, 420 and 120B of the Indian Penal Code.

3. As per the prosecution case, the informant states that he entered into an agreement with the accused persons/ director of the company namely, Narayan Mallick and Aditi Mallick (petitioner) and also gave substantial amount by way of advance to them.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. Learned counsel has submitted that

No.5891 of 2025(2) dt.17-03-2025 2/2 the petitioner has neither received the money nor she is owner of the land and the informant lodged the FIR after three years of the alleged occurrence. The name of the petitioner has transpired in this case merely on suspicion. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner, who is a lady, is in custody since 28.10.2024. The co-accused has already been granted regular bail by this Court vide order dated 01.05.2024 passed in Cr. Misc. No. 15950 of 2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Katihar in connection with Katihar Muffasil P.S. Case No. 86 of 2023.

7. The application stands allowed.
