JUSTICE ASHUTOSH KUMAR ORAL ORDER 06-02-2019 The petitioner seeks bail in anticipation of his arrest in connection with Hajipur Town P.S. Case No. 463 of 2018, dated 08.07.2018, instituted for the offences under Sections 420 and 379/34 of the Indian Penal Code, Section 11 of Gambling Act, Section 3/4 of Bihar Lottery Act and Sections 30/38 of the Bihar Prohibition and Excise Act, 2016.

After some arguments, the learned counsel for the petitioner seeks permission to withdraw this petition in order to enable the petitioner to surrender before the Court below and seek regular bail.

The petition is, accordingly, dismissed as

Patna High Court Cr.Misc. No.6892 of 2019(2) dt.06-02-2019 2/2 withdrawn.

In case, such a petition is filed before the Court below within a period of six weeks from today, the Court below shall take into account that the petitioner does not have criminal antecedents and nothing incriminating except few litres of liquor was recovered from the premises of the hotel of which he is the proprietor and, thereafter, shall pass orders in accordance with the law without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.
