====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-02-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Excise Case No. 807 of 2019 for the offenses under Section 30(a) of the Bihar Prohibition & Excise Act, 2018.

Learned counsel for the petitioner submits that nothing was recovered from the conscious possession of the petitioner. In the instant case total 60 ltrs of country made liquor was recovered from the cow shed which is an open space. The petitioner is in custody since 06.01.2020.

Considering the fact that nothing was recovered from the conscious possession of the petitioner, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named,

No.6014 of 2020(2) dt.03-02-2020 2/2 be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge VII cum Special Judge (Excise), Aurangabad, in connection with Excise Case No. 807 of 2019. However, in the event the petitioner is found involved in similar cases in future, the court below shall be at liberty to cancel the bail bonds of the petitioner in the present case.
