JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 16-09-2015 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek bail in connection with Yogapatti P.S.Case No. 66 of 2014 registered under sections 25(1B)(a), sub-sections (2) and (3) of Section 26 and 35 of the Arms Act.
The prayer for bail of the petitioners was earlier rejected by this Court on 12th December, 2014. It is contended that the petitioners are in custody since 24th March, 2014 and till date even charges have not been framed. It is also contended that the petitioner has got no criminal antecedent.
Patna High Court Cr.Misc. No.42763 of 2015 (2) dt.16-09-2015 2/2 Regard being had to the facts and circumstances of the case, the petitioners, namely, Awadhesh Choudhary and Laxman Chaudhary are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Bettiah in connection with Yogapatti P.S.Case No. 66 of 2014.
