JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-09-2022 Though the present writ petition was filed for removal of encroachment from a public land appertaining to Mauza Salempur Chadar No. 1, Circle Madhwapur, Thana No. 87, P.S. Shaharghat Old Khata No. 321, New Khata No. 1131m, Kheshra Old No. 640, New-1320, however, the learned counsel for the respondent-State has filed a counter affidavit wherein it has been submitted that encroachment proceeding has already been initiated vide Encroachment Case No. 3 of 2021-22 and the same would be concluded expeditiously.

Patna High Court CWJC No.5736 of 2021(2) dt.08-09-2022 2/2 Having regard to the facts and circumstances of the case, this Court directs the Circle Officer, Madhwapur, DistrictMadhubani to conclude the aforesaid proceedings initiated under the Bihar Public Land Encroachment Act, 1956 (hereinafter referred to as the 'Act, 1956'), within a period of 12 weeks of receipt/production of a copy of this order by passing the final order under Section 6(1) of the Act, 1956, in accordance with law and after hearing the affected parties, as also take the consequential action, thereafter without any further delay.

The writ petition stands disposed off on the aforesaid terms.
