====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 11-07-2016 Heard the learned counsel, Mr. Ajay Prasad, for the petitioner. Perused the order dated 01.06.2016 passed by Subordinate Judge IV, Patna in Eviction Suit No.59 of 2011. From perusal of the order, it appears that there is no dispute of relationship of landlord and tenant between the parties and the rate of rent.
Considering these aspects of the matter, the Court below has passed the order under Section 15 of the Bihar Building (Lease, Rent & Eviction) Control Act, in my opinion, therefore, the order cannot be said to be without jurisdiction or the Court below passed the order in the manner not permitted by law.
