2. The petitioner apprehends his arrest in connection with Complaint Case No. 1269 of 2024, registered for the offences punishable under Sections 420, 323, 506 of the IPC.

3. According to complaint petition, the petitioner sold the land in question to the complainant, knowing the fact that it was already leased out to Sugauli Sugar Factory, HPCL.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. He has submitted further that one Rajendra Singh and Most.

Patna High Court CR. MISC. No.8106 of 2025(8) dt.16-09-2025 2/3 Prabhawati Devi were title holder of that land and the petitioner purchased that land from Rajendra Singh and Mosamat Prabhawati Devi. The name of the petitioner was mutated on that land. The petitioner was not aware of the fact that the land in question has already been leased out by Rajendra Singh. The petitioner executed sale deed in favour of the complainant on the basis whereof the name of the complainant has also been mutated in the revenue records. The petitioner is a bona fide purchaser of the land in question and his intention was not to cheat anybody.

5. On the other hand, the learned counsel for the complainant has opposed the prayer for bail.

6. It appears that the petitioner is a bona fide purchaser of the land in question. If the complainant has any grievance, he may raise it against Rajendra Singh, who is said to have concealed the real facts, and sold his land to the petitioner.

7. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate,
