The petitioner seeks regular bail in connection with Riga P.S. Case No. 292 of 2018 registered for the offence punishable under Sections 399, 403 and 414 of the Indian Penal code and Sections 25(1-b)a, 26 and 35 of the Arms Act The allegation is regarding the Police having received secret information that some miscreants had assembled and were planning to commit some crime whereupon the Police officials reached at the said place whereupon the miscreants began to flee away and upon chase four miscreants were apprehended and on search one loaded pistol was recovered from the co-accused Rahul Rai while one loaded pistol was recovered from the possession of the co-accused Sudhir Paswan
Patna High Court Cr.Misc. No.8602 of 2019(2) dt.13-02-2019 2/2 and one motorcycle is said to have been recovered from the petitioner herein.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is submitted that the petitioner has a clean antecedent and the fact is that it has not been alleged that the motorcycle recovered from the petitioner is a stolen one. Lastly, it is submitted that the petitioner is languishing in custody since 05.10.2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sitamarhi in connection with Riga P.S. Case No. 292 of 2018.
