JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-05-2019 Earlier prayer for anticipatory bail of the petitioner was rejected twice, firstly vide order dated 01.09.2004 passed in Cr. Misc. No. 25170 of 2004 and secondly vide order dated 21.05.2008 passed in Cr. Misc. No. 19138 of 2008. Agains an application for grant of anticipatory bail in connection with Town P.S. Case No. 150 of 2003, disclosing offences under Sections 420, 408, 409, 467, 468, 471 of the Indian Penal Code.

Allegation against the petitioner is of defalcating a sum of Rs.1,57,463/- of the Bank of Baroda.

Having heard both sides, considering the fact that the prayer for anticipatory bail of the petitioner has been rejected twice almost 15 years ago and in spite of that petitioner has not surrender and now filing this application for anticipatory bail, I am not inclined to grant anticipatory bail to the petitioner, rather he should move for regular bail, which shall be considered and disposed of, if possible, on the same day.

Accordingly, this application is dismissed.
