2. The petitioners apprehend their arrest in a case registered for the offence under Sections 304(B), 201/34 of the Indian Penal Code.
3. Allegation against petitioners is of commission of torture and cruelty to the daughter of informant for dowry. It is alleged that this petitioner along with other accused persons committed the murder of daughter of informant due to nonfulfillment of demand of dowry.
4. Petitioner No.1 is father-in-law and petitioner No.2 is mother-in-law of the deceased. Specific accusation is against husband of the deceased who is already in custody. Petitioners
Patna High Court CR. MISC. No.12151 of 2024(3) dt.16-04-2024 2/2 are separate in mess and property and have got no concern with the family affairs of deceased and her husband.
5. Learned counsel for the informant vehemently opposes the prayer for anticipatory bail of petitioners.
6. However, considering the aforesaid facts and circumstances and the fact that the petitioners are father-in-law and mother-in-law of the deceased, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bailbonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Saran at Chapra, in connection with Dighwara P.S. Case No.107 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
