The petitioner seeks bail in a case registered for the offence punishable under Sections 302/120(B)/34 of the I.P.C. and Section 27 of the Arms Act.

As per the prosecution case, all the 15 F.I.R. named accused including this petitioner alongwith 5-6 unknown accused came, armed with deadly weapons, and started abusing the informant's husband. It is alleged that thereafter, co-accused Birju Mandal fired from his pistol on the husband of informant, which hit on his head and as a result of which, he fell on the ground and thereafter, all other accused persons made indiscriminate firing on the body of informant's husband. Patna High Court CR. MISC. No.8141 of 2022(2) dt.11-04-2022 2/2 enemies. There is general and omnibus allegation of firing against all the accused persons. Specific allegation of firing is against co-accused Birju Mandal. Similarly situated co-accused persons have already been granted bail by this Court, vide orders annexed as Annexure 2 series. Petitioner is in custody since 27.11.2021.

Considering the facts and circumstances, the bail petition of petitioner is allowed. Let the above-named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai, in connection with Lakhisarai-Amahra P.S. Case No. 280 of 2020.
