The petitioner is languishing in custody since 08.02.2013 in a case registered for the offences punishable under Sections 353, 332, 307/34 of the Indian Penal Code and 27 of the Arms Act.
It is alleged that when the accused persons including the petitioner were taking away victim of a kidnapping case then firing was resorted to by the accused persons and the police. Thereafter accused persons escaped from the scene. It is submitted by learned counsel for the petitioner that the petitioner is not named in the FIR. The name of the petitioner subsequently sprang up during investigation.
Patna High Court Cr.Misc. No.40853 of 2014 (03) dt.22-01-2015 2/2 It is submitted by learned counsel for the State that the victim in 164 Cr.P.C. statement has named the petitioner.
It appears that the petitioner is accused in five other cases. Statement to that effect has been made in para 3 of the petition.
Considering the aforesaid facts, this Court is not inclined to grant bail to the petitioner at present. Accordingly, the prayer for bail of the petitioner is rejected in connection with Sessions Trial No. 732 of 2013 arising out of Sultanganj P.S. Case No. 207 of 2012 pending in the court of learned 2nd Additional Sessions Judge, Bhagalpur. (Dinesh Kumar Singh, J) DKS/- U T
