1. Heard the parties.

2. The petitioners apprehend their arrest in connection with Dhamdaha P.S. Case No. 249 / 2024 dated 29.09.2024 registered under Sections 126, 115(2), 329(3), 303(2), 110, 74, 352, 351(2), 3(5) of the B.N.S. 2023.

3. As per the F.I.R. on 26.09.2024 in the evening at about 7 p.m. while the informant was tying her cattle the petitioners along with 7-8 unknown came and surrounded her, started

No.7613 of 2025(3) dt.13-05-2025 2/3 assaulting and some accused persons entered into her house and took away the box in which gold ornaments were kept and 05 lakh rupees cash was also taken away by them which was the sale proceed of the land sold by the informant. The petitioner no. 1 / Arjun Yadav threatened with rifle and Abhimanyu Yadav (petitioner no. 2) assaulted with pistol on hand of the informant and head of the son of the informant.

4. Learned counsel for the petitioners submits that both the parties are closely related and the petitioner no. 1 is the devar (brother-in-law) of the informant. The occurrence has taken place on account of land dispute between the parties. The injuries caused to the victims are simple in nature except one injury caused to the son of the informant near left hand opinion regarding which has been kept reserved.

5. Regard being had to the submission made by the parties, taking into consideration the fact that both the parties are closely related having land dispute and injuries sustained by the victims are simple in nature, accordingly, I am inclined to grant anticipatory bail to the petitioners.

6. Let the petitioners, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on

No.7613 of 2025(3) dt.13-05-2025 3/3 furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in connection with Dhamdaha P.S. Case No. 249 / 2024 subject to the condition as laid down under Section 482 (2) of the B.N.S.S.
