In this case, the petitioner seeks to challenge the order, dated 07.03.2016 passed by the Special Judge, Vigilance Trap, Patna in Special Case No. 32 of 2015, (arising out of Vigilance P.S. Case No. 51 of 2015).

Learned Counsel for the petitioner submits that the seizure list witnesses are the driver of the informant and a Home Guard Jawan, who is working under the informant came from District-Saharsa, itself vitiates the search & seizure as well as shows the biasness of the informant. These are all matter relates to documentary evidence, cannot be looked into in the present quashing proceeding. However, the petitioner is at liberty to raise all such grounds during the trial.
