Petitioner apprehends arrest in a case registered for the offences punishable under Section 392 of the Indian Penal Code.
As per prosecution case, four F.I.R. named accused persons including this petitioner surrounded the informant and assaulted him after wrapping Gamchha around his neck. It is further alleged that also snatched some cash and the motorcycle. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner has been made accused only on the basis of confessional statement of co-accused and no incriminating
Patna High Court CR. MISC. No.8195 of 2023(2) dt.12-05-2023 2/2 article has been recovered from possession of the petitioner. Petitioner has got clean antecedent.
Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-1st, Sherghati, Gaya in connection with Barachatti P. S. Case No. 672 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
