JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-02-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 167 of 2018 in which cognizance has been taken under Section 498A of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act. Allegation against the petitioner is that he ousted his wife (complainant) from his house and he has performed second marriage with another lady.

Submission of learned counsel for the petitioner is that he is still ready to keep his wife (complainant) with him. Heard learned APP and learned counsel for the complainant, who has opposed the prayer for anticipatory bail of the petitioner stating that no purpose will be served in keeping

Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner is rejected.

This application is, accordingly, dismissed.
