The petitioner seeks bail in connection with Excise P. S. Case No.475 of 2021, P.R. No.08 of 2021, instituted for the offences under Sections 30(a) and 32(3) of the Excise Act. The learned counsel for the petitioner submits that the petitioner is in custody since 26.11.2021, he is a person with clean antecedent and prosecution report has been submitted in the case.

Allegation is of recovery of 60 litre of liquor from a jerkin.

The learned counsel for the petitioner submits that the petitioner had parked his motorcycle and had gone to a shop and

Patna High Court CR. MISC. No.8313 of 2022(2) dt.09-03-2022 2/2 when he came back, he saw the police standing near the motorcycle as someone had left the jerkin on the seat of the motorcycle and the petitioner came to be implicated. The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent and prosecution report has been submitted in the case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 1,000/- (Rupees One Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Court No.II, Muzaffarpur in connection with Excise P. S. Case No.475 of 2021, P.R. No.08 of 2021.

The application stands allowed.
