The writ petition was filed for issuance of an appropriate writ/writs or direction/directions in the nature of mandamus commanding the respondent-University to grant permanent affiliation to the College by revising/modifying the Notification contained in Memo No PUP (ICSC-15/19) - R/19249 dated 15.03.2019 issued under the signature of the Registrar, Purnea University, Purnea by which affiliation has been granted to the Petitioner - College for the academic session

Patna High Court CWJC No.2073 of 2020(7) dt.25-09-2020 2/3 2019 - 2020 only; whereas the Petitioner - College claims that it has to be granted affiliation from the academic session 2019 - 2020 and onward.

Respondents took a stand that inadequate academic staff was found to be working at the Petitioner - College. University had sought guidelines from the National Council for Teachers' Education (for brevity, NCTE) vide its Communication dated 11.05.2019, for affiliation beyond 2019 - 2020.

After arguments on the last few dates, today when the matter is taken up, Mr Siya Ram Sahi, referring to Communication dated 19.07.2020 addressed to the Registrar, Purnea University, submits that for filling up the vacancy of Faculty Members, the process has been initiated and Advertisement has also been published inviting application. The University has been requested by the said Correspondence for sending a University Representative (for brevity, UR) for completing the entire selection process. It is submitted that once the selection process is completed, the petitioner would pursue the issue before the National Council for Teachers Education (for brevity, NCTE).

Having regard to the pandemic circumstances, Mr

Patna High Court CWJC No.2073 of 2020(7) dt.25-09-2020 3/3 Rakesh Kumar Samrendra submits that for taking follow up action for facilitating selection in terms of Correspondence dated 19.07.2020, at least four weeks time should be granted to the University.

In view of the aforesaid submissions and since petitioner proposes to pursue the matter before the NCTE upon completion of the selection process, pendency of the writ petition would be futile.

In view of the submission of the parties, this Court would observe that the University shall send its representative in terms of the Requisition dated 19.07.2020 within a period of four weeks from the date of receipt/production of a copy of this order so as to facilitate the process of selection. Writ petition is disposed of.
