JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-03-2020 The petitioners seek regular bail in connection with Madhubani Town P.S. Case No. 210 of 2019, registered for offences punishable under Section 379, 401/34 of the Indian Penal Code.
Allegation is of commission of theft of motorcycle. It appears that petitioner is not named in the F.I.R, later on his name transpired on confession of the co-accused. Apart from that he is accused in six other cases.
It has been submitted on behalf of the petitioners that in this case, save and except confessional statement of coaccused, there is absolutely nothing against the petitioner and he has been in custody since 09.08.2019.

Having heard both sides, in view of the above facts, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani, in connection with Madhubani Town P.S. Case No. 210 of 2019, subject to the condition that petitioner has to appear before the Officer-inCharge of the police station of his area in the first week of each month for a period of six months so that the police may watch his activities during that period and if in that period, petitioners' involvement is found in any other serious nature of case, prosecution will be at liberty to move for cancellation of their bail bonds.
