The petitioner seeks bail in a case registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code.
The petitioner is not named in the FIR. From possession of the petitioner one stolen mobile was recovered thereafter many other articles were also recovered from possession of the petitioner.
It is submitted that other articles were not put on test identification parade. The petitioner is said to have confessed his guilt before the police. It is further submitted that the petitioner purchased the mobile and he had no knowledge about the theft of the aforesaid mobile. The petitioner is in jail since 28.06.2015 and
Patna High Court Cr.Misc. No.41001 of 2015 (2) dt.09-09-2015 2/2 he has got no criminal antecedent.
Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in Sitamarhi P.S.
