JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-01-2022 Heard Mr. Yashraj Bardhan, learned Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Avatar Nagar P.S. Case No. 278 of 2020 dated 27.10.2020 instituted for the offences under Sections 30a, 37c of the Bihar Prohibition of Liquor Amendment Act, 2016.

On secret information that the petitioner has stored liquor in an unauthorized manner in his house, a raid was conducted. However, the recovery of Mahua liquor is from a hut situated across the house of the petitioner. Two persons were seen fleeing away from that house, who were found to be in drunken state. Learned counsel for the petitioners has submitted that there is no recovery from his house and

He does not have criminal antecedents.

Regard being had to the aforestated facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ-II-Cum-Special Judge, Excise, Saran at Chhapra in connection with Avatar Nagar P.S. Case No. 278 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
