Petitioner is in custody in connection with Special Case No. 9012 of 2018 arising out of Bikram P.S. Case No. 295 of 2018 for the offence under sections 37(b), (c) of Bihar Excise Prohibition Act, 2016 and 25(1-b)a, 26, 35 of the Arms Act. Learned counsel for the petitioner would submit that in the instant case there is allegation that one katta with live cartridge was recovered from the possession of the petitioner. Learned counsel submits that petitioner is in custody since 27.9.2018.

Considering the fact that petitioner has remained in custody for more than four months, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.6516 of 2019(2) dt.05-02-2019 2/2 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge Excise, Patna, in connection with Spl. Case No. 9012/2018 arising out of Bikram P.S. Case No. 295 of 2018.
