JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-03-2024 This petition has been filed for quashing the order dated 05.05.2017 passed by learned J.M. 1st Class, Gaya in Complaint Case No. 93 of 2017 / TR No. 2476 of 2018 whereby the learned Magistrate has directed for issuance of summon against petitioners under Sections 323, 379, 504, 506, 34 of the Indian Penal Code.

However, after some argument, learned counsel for the petitioners seeks permission to withdraw this petition granting liberty to the petitioners to raise all the points, which have been taken in the present petition, before the learned Court below at the time of framing of charge /appropriate stage.
