JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-09-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The accusation against the petitioners is that they alongwith two others intercepted the vehicle of the informant and demanded extortion money and, thereafter, snatched cash and mobile sets but while they were fleeing, Police party reached there and arrested the petitioners whereas two persons managed to escape from there. The contention on behalf of the petitioners is that the prosecution story as propounded by the informant is completely concocted and as a matter of fact, accident took place in which the vehicle of the petitioners got damaged and, thereafter, heat exchange of words took place between the parties, but in the

Patna High Court Cr.Misc. No.42640 of 2015 (2) dt.16-09-2015 P2/2 meantime informant called one of his relatives who happens to be a Police Officer and, thereafter, informant implicated the petitioners in the present case. It is further pointed out on behalf of the petitioners that petitioners do not have any criminal antecedent.

Accordingly, petitioners are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No. 90/2015.
