JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-03-2023 This application has been filed for restoration of Cr. Misc. No. 37466 of 2022 which was dismissed for nonprosecution vide order dated 30.09.2022. It is submitted on behalf of petitioner that Advocate Clerk could not mark the case of petitioner. Consequentially, the arguing counsel could not appear on call of the case. Petitioner would suffer a lot, if the present case will not be restored to its original file.

I am not satisfied with the reasons assigned, therefore, this application for restoration of Cr. Misc. No. 37466 of 2022 to its original file, is rejected.
