The learned counsel for the applicant argued that vide order dated 05.02.2021 passed by my learned Predecessor, liberty was granted to the applicant to renew his prayer if the trial is not completed within a period of nine months. He further argued that only motorcycle of the present applicant was found on the spot of the incident.

The learned Additional Public Prosecutor appears for the State.

The annexures filed with the application itself shows that the trial is under the process of recording of witnesses. In this view of the matter, the application be disposed of with the direction to the learned Trial Court to keep in mind
