Mr. Satyendra Prasad ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 31-01-2020 Heard learned counsel for the petitioner and State. The petitioner, who is a constable, is in custody in connection with Kotwali P.S. Case No. 488 of 2019 for the offence under Sections 384, 386/34 of the Indian Penal Code. Allegation against this petitioner is that he demanded Rs.3,00,000/- (Three lakh) for removing the name of the informant and his father and uncle, who were made accused in Pipariya (Lakhisarai) P.S. case no. 31 of 2019. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 17.12.2019.

Considering the fact that the petitioner is a constable and not the investigating officer, who would have extended favour to the informant and his family members, the petitioner, named

Patna High Court CR. MISC. No.5651 of 2020(2) dt.31-01-2020 2/2 above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Munger in connection with Kotwali P.S. Case No. 488 of 2019.
