JUSTICE KISHORE KUMAR MANDAL ORAL JUDGMENT Date: 22-10-2016 Heard the counsel for the petitioner and the State. A counter affidavit is filed on behalf of the concerned State respondent.

The petitioner being the widow of the deceased employee has filed the present writ application for payment of the death-cum-retiral dues payable on account of the death of her husband who was serving as Panchayat Sewak until he died in harness.

The counsel for the State, on the basis of the averments made in paragraph 12 to 17, states that the grievance of the petitioner for payment of the retiral dues was examined in consultation with the petitioner and after obtaining her affidavit all the admissible dues have been sanctioned inasmuch as the payment has also been made. If there are certain more outstanding dues, the

The Court on a consideration of the submission advanced by the parties and taking into account the stand taken in the counter affidavit is satisfied that the grievance of the petitioner has substantially been redressed . If there are certain more outstanding dues or discrepancy in calculation of the amount is found, the petitioner would be at liberty to ventilate her grievance by filing an application before the respondent no.5 who shall consider/examine the representation of the petitioner and take appropriate decision thereon in accordance with law without much delay.

The writ application stands disposed of.
