The petitioner seeks bail in Kudhani P.S. Case No. 42 of 2020, registered for the offence punishable under Sections 413, 414, 420 and 34 of the Indian Penal Code. As per the prosecution case, during patrolling duty informant along with other police officials reached near Chandarhatti Pawapuri Petrol Pump and saw two motorcycles parked near ATM and one boy inside the ATM. The police caught the boy inside the ATM and rest accused persons fled away. The apprehended boy disclosed his name as Sunny Kumar (petitioner) and from his possession mobile phone, some devices as well as two ATM card have been recovered. It is submitted on behalf of the petitioner that no incriminating article or ATM card has been recovered from
Patna High Court CR. MISC. No.18198 of 2021(4) dt.29-11-2021 2/2 possession of this petitioner. Whatever has been recovered belongs to this petitioner and the same is not stolen one. Petitioner claims clean antecedent and he is in custody since 25.01.2020.
Considering the facts and circumstances of the case and clean antecedent of the petitioner, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Muzaffarpur in connection with Kudhani P.S. Case No. 42 of 2020.
