The petitioner is apprehending his arrest in connection with Baniyapur P.S.Case No.63/18 , registered for offences punishable under Sections 379 of the Indian Penal Code. Allegation against the petitioner is of theft of the valuable articles from the temples. The petitioner is not named in the FIR and later on his name transpired on confessional statement of the co-accused.

Submission of the learned counsel for the petitioner is that nothing has been recovered from his house and he has been made accused in one more case but that case also relates to the present occurrence.

Having heard both sides and in view of the facts and

No.7367 of 2019(2) dt.07-02-2019 2/2 circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Saran at Chapra in connection with Baniyapur P.S.Case No.63 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid observation, this application is allowed.
