This application for grant of regular bail arises out of R.C. No. 13A/2017 (Special Case No. 7/2017), registered for the offence punishable under Sections 409, 320, 467, 468, 471, 120(B)/34 of the Indian Penal Code and Section 13(2) read with 13(1)(d) of the Prevention of Corruption Act, 1988. The petitioner is in custody since 25.03.2019. His application for regular bail was earlier rejected by an order of this Court dated 10.06.2020 passed in Cr. Misc. No. 76182 of 2019 with an observation that the petitioner shall be at liberty to renew his prayer for bail after six months, if, in the meanwhile,

The case of the prosecution has been narrated in detail in the said order dated 10.06.2020.

Mr. Ajay Kumar Thakur, learned counsel appearing on behalf of the petitioner has submitted that all persons except the petitioner, who have been charge-sheeted in the present case, i.e., R.C. No. 13A/2017 (Special Case No. 7/2017), have been allowed regular bail by this Court by various orders. He has further submitted that the petitioner is a Government servant and there is no likelihood of his fleeing from the course of trial. The submission that other similarly situated persons, who have been implicated in this case, have been allowed regular bail is not being disputed by Mr. Bipin Kumar Sinha, learned counsel representing the Central Bureau of Investigation.

He has submitted that the petitioner had filed an application for discharge before the Court below and at his instance the hearing of the said application was adjourned and, therefore, he should be blamed for delay in trial. Be that as it may, considering the period of incarceration and the fact that the similarly situated persons have been allowed regular bail, this application is allowed.

Patna High Court CR. MISC. No.15647 of 2021(6) dt.30-06-2021 3/3 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge CBI-II, Patna, in R.C. No. 13A/2017 (Special Case No. 7/2017).
