JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 31-01-2020 Heard learned counsel for the petitioners and State. The petitioners are in custody in connection with Araria P.S. Case No. 779 of 2019 for the offence under Sections 379/411 of the Indian Penal Code.

Allegation against the petitioners is that they were involved in theft of motorcycle.

Learned counsel for the petitioners submits that the petitioners were not named in the F.I.R. and their name surfaced on the basis of confessional statement of co-accused Siddique Alam @ Siddik Alam. The petitioners were remained in this case on 24.10.2019.

Considering the fact that the petitioners were not
